 World of Warcraft maker Activision Blizzard is the latest target of a lawsuit by serial suer (or professional plaintiff) Erik Estavillo.

Filed this morning in the Civil Division of the Superior Court of California, County of Santa Clara, the civil complaint charges Activision Blizzard with “deceitful” business practices, as it “continues to maintain a harmful virtual environment to many of its customers by forcing them to follow the game’s sneaky and deceitful practices.”

Among Estavillo’s claims is that WOW is designed for a gamer “to walk or run at a calculated slow pace, resulting in the player taking longer to get where he or she needs to go in the game.” This slow pace, says the plaintiff, leads to a longer time needed to finish game play or quests, in turn leading to more subscription revenue for Activision Blizzard.

Estavillo also complains that faster transportation is not available until a player levels up accordingly, or purchases an expansion pack.

The plaintiff then likens his health problems (OCD, Agoraphobia, Panic Disorder, major depression and Crohn’s Disease) to the afflictions that ailed the late EverQuest gamer Shawn Woolley, who took his own life on Thanksgiving morning in 2001.  Estavillo stated that he “doesn’t want to end up like Shawn did as he [Estavillo] relies on videogames heavily for the little ongoing happiness he can achieve in this life.”

Estavillo subpoenaed Depeche Mode founder Martin Lee Gore and actress Winona Ryder to provide testimony on his behalf regarding the subject of alienation.

Gore was subpoenaed because “he himself has been known to be sad, lonely, and alienated as can be seen in the songs he writes,” and Ryder because of her and Estavillo’s common interest in the J.D. Salinger book The Catcher in the Rye. Ryder would be able to, “explain the significance of alienation in Catcher in the Rye and will also testify to how alienation in the book can tie to alienation in real live/video games such as World of Warcraft.”

Estavillo is seeking punitive damages of $1.0 million and a court order that WOW implement changes that address the issues of his complaint.

Other lawsuits filed by Estavillo include one against Sony Computer Entertainment America (SCEA), following a banning from the PlayStation Network, and a recent suit that targeted Microsoft and Nintendo—the former over an Xbox 360

hahahahaha oh my god  happy no
this inspires me though...I got a paper cut on a page of a book I was reading today and it still hurts...so maybe I'll sue the publishing company for making the paper too sharp? I guess...and then maybe I'll subpoena Winona...because Winona reads books, so she can understand the pain that one gets from a paper cut while reading...sounds like a plan   rock

Yep, it was a project that was supposed to be made in 2000, I believe. I remember being really excited for this project... just the thought of Johnny and Winona being in a film together again was really exciting! Yeah, but Michelangelo Antonioni was a great director... too bad there is no chance of this film being made now, as he's been dead for a few years.  Cry

When we first learned that The Office scribes Lee Eisenberg and Gene Stupnitsky had sold a spec called Bad Teacher, there was -- of course -- chatter about who that teacher should be. Anna Faris, Tina Fey, Elizabeth Banks, Winona Ryder, and Angelina Jolie were names batted around, but they're nothing like the reality.

I'm sorry to report that according to Variety, Cameron Diaz will be the lucky lady Bad Teacher for Columbia Pictures. The film focuses on a foulmouthed gold digger middle-school teacher. When she's dumped by her sugar daddy boyfriend, she turns her romantic attentions to her colleague, but has to battle the school's model teacher -- her rival -- for the honor. (Variety now says she battles a colleague for the affections of the model teacher, but that might be a mix-up.)

Jake Kasdan is helming the comedy, which isn't too bad, but it's not hard to be worried about the end result. Eisenberg and Stupnitsky wrote Year One, which didn't do very well at all -- it barely made back its budget. With Diaz? That doesn't instill confidence for something really great and memorable, unless we get some good Office humor mixed with, maybe, some Being John Malkovich Diaz?

The production is scheduled to kick off in LA this Spring.

I must agree. At first you may think that is a shoo-in for Winona. However, these days, I get the impression that she may want to move out of those fun coldish persona type roles mostly and into a more genuinely nice and graceful level of characters. Let's hope. But a little twangy trademark look in any role would never hurt.

Nope, no word on stay cool, yet. I'm assuming it will come out this year. I keep asking the polish brothers, but last they told me was to look for it in October 2009!  read the f'n manual That was three months ago! Soooo... hopefully soon! Also, don't forget about "When Love is Not Enough." That is to air on CBS in April! I think film has the potential of being very good! Let's hope for more great Winona films to be announced- soon! happy yes

I've decided to remove all of that fun stuff that was off topic here in this thread. Please try to keep your conflicts shorter in the future. It took me far too long to delete all of that spew. Tongue

Also private messages are a good idea, although I've got no problems with publicly calling someone on their behavior here. At some point though it gets out of control, and if I feel like it I'll step in and do whatever I feel is needed.
